Quizrael Terms of Use
Draft for review. These terms are not legal advice; a lawyer should review them before monetization at the latest.
Last updated: [PLACEHOLDER: date of publication]
These terms are an agreement between you and [PLACEHOLDER: the owner's full legal name, or the business name and registration number], [PLACEHOLDER: postal address], Israel ("we", "us"), the operator of Quizrael. By using the app you accept them. If you do not accept them, please do not use the app. Our Privacy Policy explains how we handle your information and is part of these terms.
The service
Quizrael is a trivia game about the geography of Israel: questions, maps, an encyclopedia of places, progress, badges and leaderboards. The game is offered free of charge. We may add, change or remove features, topics and questions, and we may suspend or end the service, at any time. We will try to give notice in the app of a change that matters to you.
Who may use it
You must be at least 18 years old to use Quizrael. By using it you confirm that you are.
Your account
The app creates an anonymous account for your phone the first time you open it, and you can play as a guest. Your progress is linked to that account. A guest account cannot be recovered if the app is deleted, the phone is lost or reset, or you log out; you may lose your progress. When signing in becomes available, you can link the account to an email address or an Apple, Google or Facebook account to keep your progress across phones. You are responsible for the activity on your account and for keeping access to the sign-in method you use.
You may delete your account at any time, as described in the Privacy Policy.
Fair play and acceptable use
You agree not to:
- cheat, including by automating answers, using bots or scripts, manipulating the app, its traffic or its clock, or exploiting a bug for points, XP, hearts, hints or rank (please report bugs instead);
- create accounts in bulk, or use more than one account to gain an advantage on leaderboards;
- choose a display name that is offensive, hateful, sexual, threatening, misleading, impersonates someone, or contains a link or advertising;
- copy, scrape or extract the app's questions, maps or encyclopedia in bulk, or reverse engineer the app or its server, except as the law allows;
- interfere with or overload the service, or try to access data that is not yours;
- use the app in any way that breaks the law.
We may remove a display name, reset scores obtained unfairly, remove a player from leaderboards, or suspend or delete an account that breaks these rules. Where reasonable, we will tell you why.
Hearts, hints, XP, badges and other virtual items
Hearts, hints, XP, levels, tiers, streaks, badges, cosmetics and any other in-game items are part of the game. They have no monetary value, cannot be exchanged for money, and cannot be sold, transferred or traded. They are licensed to you for use in the game, not owned. We may change how they work, how many you receive, and what they do, including to keep the game balanced, and they end when your account is deleted or the service ends.
Content and accuracy
The facts in Quizrael (places, borders, populations, roads, streams and the rest) are taken from official Israeli sources, listed in the app under "About the data", and are used under those sources' terms. Municipal emblems come from Wikimedia Commons under their own licences. We work to keep the data correct and current, but data changes, sources differ and mistakes happen. The game is for learning and entertainment; do not rely on it for navigation, legal, planning, safety or any other decision. If you spot an error, tell us through the feedback button.
Maps in the app show boundaries as the official sources publish them and are not a statement on any political question.
Intellectual property
The app, its design, its questions and texts, its maps as drawn, the Quizrael name and logo, and the hoopoe mascot belong to us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial play. You may share the result cards the app makes for sharing. Data from official sources remains subject to the sources' own terms.
Feedback you send us may be used to improve the app without obligation to you.
No warranty
The app is provided "as is" and "as available". To the extent the law allows, we make no promise that it will be uninterrupted, error-free or fit for a particular purpose, or that your progress will never be lost.
Limitation of liability
To the extent the law allows, we are not liable for any indirect, incidental or consequential damage, or for loss of data, progress or virtual items, arising from the use of the app or the inability to use it. Our total liability for any claim relating to the app is limited to [PLACEHOLDER: the amount you paid us in the 12 months before the claim, or ₪100 if you paid nothing]. Nothing here limits liability that cannot be limited by law.
Ending use
You can stop using the app and delete your account at any time. We may suspend or end your access if you break these terms, or if we end the service. The sections on virtual items, intellectual property, no warranty, limitation of liability and governing law continue after that.
Changes to these terms
We may update these terms. We will update the date at the top, and for an important change we will tell you in the app before it takes effect. If you keep using the app after a change takes effect, you accept the new terms.
Governing law
These terms are governed by the laws of the State of Israel. The competent courts in [PLACEHOLDER: Tel Aviv-Jaffa] have exclusive jurisdiction over any dispute about them, except where the law gives you the right to sue elsewhere.
Language
These terms are published in Hebrew and English. If the two differ, the Hebrew version prevails.
